What are the different types of arrangements that parents can make for their children?
In Ontario, there are many different arrangements regarding decision-making and parenting time. To determine which arrangements are best for your family, parents (when drafting custody agreements) or the court (in litigation) will take the children's best interests into account when determining the best arrangement for the children. Below are some of the more common arrangements.
Sole Decision-Making Responsibility- one parent is granted the responsibility to make the majority of decisions regarding the children. In most cases, the children will reside with that parent and the other parent will have reasonable parenting time.
Joint Decision-Making Responsibility- both parents share the responsibility of decision-making in the children's upbringing. In this case, parents must figure out how to agree on decisions regarding the children. Children do not necessarily spend equal time with each parent and one parent may still be the primary caregiver.
Shared Parenting Time- similar to joint decision-making, but the parents also share parenting time. Each parent has the children in their care 40-60% of the year.
All arrangements should be made with the best interests of the children in mind.
What does "best interests of the child" mean exactly?
The factors that the court take into account differ depending on each child's age and stage of development and can include such things as:
the child's relationship with each parent and their siblings;
the history of the care of the child from birth to present day;
plans for future care of the child;
each parent's ability to support the child from a mental as well as a physical aspect;
any family violence that has occurred; and
the views of the child, if applicable, taking into account the child's age and maturity.
